For the highest quality patents, you need an agent or attorney with a tremendously diverse background. The value that a patent agent or attorney provides is someone who looks at the invention in several different manners.
The first manner is that of a patent prosecutor. A patent application is written so that it meets all of the requirements of the Patent Office and in a way that will make it easy for an Examiner to allow the case.
Another manner is that of technologist. The patent writer must understand the intricacies of the technology, appreciate the subtleties of the invention, and comprehend the relationship of the invention to the current state of the art.
The third manner is that of futurist. Because the patent will be in effect for two decades, the good patent agent or attorney will try to visualize how the invention will look five, ten, fifteen, and twenty years into the future. This vision comes through in suggesting different embodiments and crafting claims that will be useful twenty years hence.
Yet another manner is that of businessperson. The useful patent will fit into the business plan of the owner. It will have a value as an offensive and defensive tool. It will be crafted with an eye toward potential infringers and so that the core business will be protected.
The competent agent or attorney understands the legal implications of the documents he or she creates. The agent is up to date on the recent court rulings and interpretations of patents and makes sure that the documents he or she creates today can withstand a court challenge in the future.
My personal history is that of an engineer and inventor who began writing patents as a hobby, planning on inventing and licensing technology. I have worked with patent attorneys as an inventor at several large companies and as an independent inventor. I have seen knowledgeable managers wield patents as defensive and offensive weapons, and seen uneducated managers bungle patents and waste resources. At every step of the way, I have tried to understand what worked and what didn’t work, so that I can share that with my clients today.
